    Protest of the pay out to suspects family while attempting to run over APD Cops and how can they be fired? "Shooting at a moving vehicle" who lives or who dies? STATE LAW, SAYS OTHERWISE WHEN A SUSPECT IS USING HIS STOLEN VEHICLE TO CAUSE DEATH OR BODILY HARM, OR THE HARM OF THE OTHERS, How can the Chief Oates's Aurora police policy supersedes the State Law? How can he fired these officers? Police News and PROTEST at AMC - Support officers 12-2011, the community is outraged and furious. Fri, November 25, 2011 PROTEST...PROTEST ...on 12-6-2011 and on the 7th, at the AMC facility regarding a 7 news story on the shooting 3-20-2011, the wife of the police officer is bashing the City for the pay out to suspects of a crime and attempting to kill 2 APD officers! Gidenko, Yevgeniy Straystar Shot Fleeing Storage Yard, Police Say on November 18, 2011 AURORA, Colo. -- Aurora is paying $390,000 to the victims of a police shooting. On March 20, Oleg Gidenko, Yevgeniy Straystar and a friend went to a fenced car storage lot because Gidenko needed a new door for a relative's car. The men took a door from a Toyota Corolla parked in the lot and put it in a STOLEN truck that Gidenko was driving, according to the District Attorney's Office. Evidence and witnesses, cited in the letter, said the two officers fired more than a dozen shots at the truck after Gidenko tried to speed from the lot. The letter indicates Gidenko hit one officer and tried to hit another officer. The injuries to the officer were not life-threatening. Gidenko was shot in the head and died almost instantly. The city attorney Charlie Richardson and the Chief Oates settled with Gidenko's family for $150,000. Yevgeniy "Eugene" Straystar, 18, was also shot, but survived. The city of Aurora has agreed to pay his family $215,000 plus another $25,000 in medical costs. Straystar is paralyzed on the left side of his body. The city settled with Straystar because Aurora Police Chief Dan Oates felt the officer who shot Straystar violated police policy for using deadly force. Police policy says a vehicle driving in the direction of an officer is not reason enough to open fire. The wife of the officer states, his police policy is not the State Law policy and he can not supersede the State Law, that you can shoot at a moving vehcile if bodily deadly force is being used with a moving vehicle and/or the life of others. However, the district attorney's office said officers' lives were in danger and their actions justified. The wife of the officer involved in the shooting said the settlement sets a bad example for the Police Department of officers saving their lives in this situation and the criminals on the streets. “I was sick to my stomach. I was literally sick to my stomach," said JoeAnn Falco, wife of officer John Falco. “When did my husband’s or any APD officers life become LESS valuable than the crooks on the street? Basically that’s what it is.” She said the payout to the family should never have happened and does not know why the City Attorney or Chief did this, it makes no sense why are we rewarding criminals they caused their own fate that night? The shooting was justifiable. Even the DA justified the shooting," JoeAnn Falco said. "(The officers) have to second guess when they are going to be in this situation, who lives or who dies and this will happen again and when are we going to stop paying people for doing bad things. These 3 suspects have been hitting that place for months. Even the owners of these auto shops say, that they are tired of it and it has stopped since this incident. The two officers may be fired or unpaid leave and for what doing their job and saving their lives. I feel that Officer Falco deserves a commendation for saving his life and his partners and that he be placed in Traffic Ops on swing where he belongs. The City Attorney of Aurora Charlie Richardson and the Chief made a bad call on this pay out of 390K, and the community (public) all over are furious!
